CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE NO. 1852 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF <br />SOUTH BAY CONSTRUCTION FOR A MODIFICATION TO <br />A PUD DEVELOPMENT PLAN, AS FILED UNDER CASE <br />PUD-02-2M <br /> <br />WHEREAS, <br /> <br />South Bay Construction has applied for a modification to the approved PUD <br />Development Plan for eight office buildings comprising 745,000 square feet of <br />floor area and related facilities to delete the two-year construction timing <br />condition, thereby extending the development plan approval for the same time <br />period as the vesting time period of the "Development Agreement" for the "Bernal <br />Property PUD", which expires on August 21, 2010; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C/O <br /> (Commercial/Office) District; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, at its meeting of February 27, 2002, the Planning Commission recommended the <br /> conditional approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the City Council on April 2, 2002; <br /> and <br /> <br />WHEREAS, the City Council finds that the modification is appropriate. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: <br /> <br />Approves Case PUD-02-2M, the application of South Bay Construction for a <br />modification to the approved PUD Development Plan for eight office buildings <br />comprising 745,000 square feet of floor area and related facilities to delete the <br />two-year construction timing condition, thereby extending the development plan <br />approval for the same time period as the vesting time period o the "Development <br />Agreement" for the "Bernal Property PUD," which expires on August 21, 2010, <br />subject to the conditions shown on "Exhibit B", attached hereto and incorporated <br />herein by this reference. <br /> <br /> <br />
