CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 13 7 4 <br /> <br /> AN URGENCY ORDINANCE REPEALING CHAPTER 17.08 (FLOOD <br /> DAMAGE PREVENTION) IN ITS ENTIRETY AND ADOPTING A <br /> REVISED CHAPTER 17.08 (FLOOD DAMAGE PREVENTION) <br /> <br />WHEREAS, Pleasanton must modify its floodplain management <br /> ordinance to comply with the National Flood <br /> Insurance Program or be suspended from that <br /> program; and ' <br /> <br />WHEREAS, the risk of suspension from that program creates an <br /> emergency situation as Pleasanton's citizens and <br /> property owners would be at risk in the event of a <br /> flood disaster and would have real property <br /> transactions disrupted by loss of use of certain <br /> federally-insured and/or subsidized loans; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: Chapter 17.08 (Flood Damage Prevention) is hereby <br /> repealed in its entirety. <br /> <br />Section 2: A new Chapter 17.08 (Flood Damage Prevention) is <br /> hereby adopted as an emergency ordinance, to take effect <br /> immediately, as shown in Exhibit A, attached hereto and <br /> incorporated herein by reference. Pursuant to <br /> Government Code Section 36937, the urgency is based on <br /> the following findings: <br /> <br /> a. The flood hazard areas of the City may be subject <br /> to periodic inundation which may result in loss of <br /> life and property, health and safety hazards, <br /> disruption of commerce and governmental services, <br /> extraordinary public expenditures for flood <br /> protection and relief, and impairment of the tax <br /> base, all of which adversely affect the public <br /> health, safety, and general welfare; <br /> <br /> b. In order to minimize adverse effects, insure <br /> potential buyers are notified that property is in <br /> an area of special flood hazard, and insure that <br /> those who occupy the areas of special flood hazard <br /> assume responsibility for their actions, the public <br /> safety and welfare require that uses vulnerable to <br /> floods, including facilities which service such <br /> uses, be protected against flood damage at the time <br /> of initial construction; and <br /> <br /> <br />
