CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-035 <br /> <br />RESOLUTION APPROVING THE APPEAL OF THE <br />DECISION OF THE PLANNING COMMISSION THEREBY <br />APPROVING THE APPLICATION OF FRANK AND <br />BARBARA BERLOGAR FOR PARCEL MAP PMS-09 <br /> <br />WHEREAS, <br /> <br />at its meeting of February 13, 2002, the Planning Commission denied, Case <br />PMS-09, the application of Frank and Barbara Berlogar for a parcel map that <br />would allow the division of an existing, 45.03 acre property into two parcels - <br />Parcel One, 7.57 acres in area and Parcel Two, 37.46 acres in area - in <br />conformance with PUD-5, an approved PUD Development Plan; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR/HR/OS (Low <br /> Density Residential, Hillside Residential, and Open Space); and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Frank and Barbara <br /> Beflogar submitted an appeal; and <br /> <br />WHEREAS, a public hearing was held before the City Council on April 2, 2002, at which time <br /> all pertinent testimony and documents were reviewed; and <br /> <br />WHEREAS, <br /> <br />the City Council finds that the proposed parcel map is consistent with PUD-5, the <br />PUD Development Plan approved for Centex Homes, and the Vineyard Avenue <br />Corridor Specific Plan. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CiTY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Upholds PAP-29, thereby approving PMS-09, subject to Exhibit "B", Conditions <br />of Approval. <br /> <br /> <br />
