cultural materials and archaeological remain~ that could be uncovered in <br />future development projects through implementation of the Specific Plan. <br /> <br />Land Use Chapter Policy 30: Because the presence or absence of <br />subsurface archaeological deposits is typically unknown, construction or <br />activities caused by development projects involving subsurface disturbance <br />could uncover important buffed archeological deposits. If archaeological <br />deposits are uncovered during consmaction activities, all work shall stop <br />within a 100-foot radius of the fred until a qualified archaeologist can assess <br />the discovery. If the find is determined to be an important archaeological <br />resource, the resource shall be avoided or recovered consistent with the <br />requirements of Section 15126.4(b)(3) of the State CEQA Guidelines. <br /> <br />Land Use Chapter Policy 31: A~ archaeological treatment and monitoring <br />plan shall be prepared and implememed for any development project site <br />found to contain archaeological resources. The treatment plan shall include <br />methods for test excavation to identify resources and the level of <br />significance of subsurface prehistoric or historic archaeological items. The <br />treaunent plan shall further outline the level of mitigation necessary relative <br />to the level of construction and potential impact on the specific resource. <br />The monitoring plan shall be implemented if the construction area is deemed <br />to be sensitive and the potential to uncover previously unrecorded <br />archaeological remains appears to be high. <br /> <br />STATEMENT OF OVERRIDING CONSIDERATIONS <br /> <br />This statement of overriding considerations presents the Ci~"s determination that the <br />proposed Downtown Specific Plan Project's broader public and environmental health <br />objectives outweigh the anticipated significant and unavoidable environmental impacts of <br />the project, as identified in the previous section and the EIR. <br /> <br />Significant and Unavoidable Environmental Impacts of the Proposed Project <br /> <br />The previous section and the EIR identify the following significant and unavoidable <br />impacts of the proposed project: <br /> <br />cumulative parking impacts related to festivals and other special events <br /> <br />potential for damage to existing or proposed development and risk to people <br />from seismic shaking and/or fault rupture <br /> <br />Required Statement of Overriding Considerations <br /> <br />Downtown Specific Plan EIR Findings and Statement of Overriding Considerations Page 8 of 9 <br /> <br /> <br />
