CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-027 <br /> <br />RESOLUTION AUTHORIZING THE CITY OF <br />PLEASANTON TO ACCESS STATE AND LOCAL <br />SUMMARY CRIMINAL HISTORY INFORMATION FOR <br />EMPLOYMENT, LICENSING, OR CERTIFICATION <br />PURPOSES <br /> <br />WHEREAS, <br /> <br />California Penal Code Sections l l105(b)(10) and 13300(b)(10) authorize cities, <br />counties and districts to access state and local summary criminal history to <br />implement a statute, ordinance, or regulation relating to employment, licensing or <br />certification; and <br /> <br />WHEREAS, <br /> <br />California Penal Code Sections l l105(b)(10) and 13300(b)(10) require the city <br />council, board of supervisors, or governing body of a city, county or district to <br />specifically authorize access to summary criminal history information for <br />employment, licensing, or certification purposes; and <br /> <br />WHEREAS, <br /> <br />cities, counties, and districts are prohibited from having in certain classifications, <br />employees, volunteers or independent contractors who have been convicted of <br />specified offenses or who are required to register under specified sections of the <br />California Penal Code; and <br /> <br />WHEREAS, <br /> <br />even if the cities, counties or districts are not prohibited by statute from <br />considering a person for licensing or employment, cities, counties or districts may <br />reject for licensing or employment, a person who has been convicted of a felony or <br />misdemeanor or who is required to register under specified sections of the <br />California Penal Code, if the conviction and/or registration is related to the <br />employment, volunteerism, contract or license in question; except that such <br />conviction and/or registration may be disregarded, if it is determined that <br />mitigating circumstances exist or that the conviction and/or registration is not <br />related to the employment, volunteerism, contract, or license in question. <br /> <br />NOW, THEREFORE, THE CiTY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> <br />
