CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1364 <br /> <br /> AMENDMENTTO CHAPTER 20.08 (BUILDING CODE) RELATING <br /> TO PROCEDURES FOR ISSUANCE OF GRADING PERMITS <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: Chapter 20.08 (Building Code) of the Pleasanton <br />Municipal Code is hereby amended by adding the following: <br /> <br /> (a) Add a new section 20.08.080 to read as follows: <br /> <br /> "20.08.080 Section 7003 amended - Exceptions for <br /> requirement of grading permit. <br /> <br /> Section 7003 of the Uniform Building Code is <br /> amended by adding the following: <br /> <br /> Notwithstanding the above, no grading shall be <br /> exempt if, in the determination of the <br /> building official, the grading proposed (1) is <br /> being done in contemplation subsequent <br /> development of the site, or (2) would be <br /> detrimental to the general welfare of users of <br /> the adjoining and surrounding lots." <br /> <br /> (b) Add a new Section 20.08,085 to read as follows: <br /> <br /> "20.08,085 Section 7006(g) amended - Issuance of <br /> grading permits. <br /> <br /> Section 7006(g) of the Uniform Building Code is <br /> amended y adding the following: <br /> <br /> Notwithstanding other sections of this Code, <br /> the issuance of a grading permit shall be <br /> subject to the discretionary approval of the <br /> building official. The building official <br /> shall consider the relationship of the <br /> proposed finish grade to the finish grade of <br /> the adjoining lots and the affect of the <br /> proposed grading on ridges or other prominent <br /> visual landforms, trees and other vegetation, <br /> drainage patterns, maintenance <br /> responsibilities, and such other effects as <br /> the grading may have on the public's general <br /> welfare. Proposed grading plans shall be <br /> subject to environmental assessment pursuant <br /> <br /> <br />
