Section 2: Section 7.36.030 of the Pleasanton Municipal Code <br /> is hereby amended to read as follows: <br /> <br /> "7.36.030Canine Defecation; Removal <br /> Thereof <br /> <br /> A. Any person having the custody or control of <br /> any dog shall have the duty to remove <br /> immediately any feces left. by such animal on <br /> any public place and to dispose of such feces <br /> in a sanitary manner. <br /> <br /> B. Any person having the custody or control of <br /> any dog in or on a public place shall have in <br /> such person's immediate possession a device or <br /> equipment for the picking up and removal of <br /> animal feces. For purposes of this section, <br /> such device or equipment shall be deemed to be <br /> in a person's immediate possession if such <br /> device or equipment is in a person's hand or <br /> is on the person, such as within a pocket. <br /> <br /> C. No person shall fail or refuse to show to the <br /> director or to any police officer such device <br /> or equipment if the device or equipment is not <br /> visible. <br /> <br /> D. The provisions of subsections B and C above <br /> shall not apply to any disabled person <br /> when the person's disability requires a dog to <br /> accompany the person nor to a person using a <br /> dog in emergency or rescue activities." <br /> <br />Section 3: Chapter 13.08 of the Pleasanton Municipal Code, <br /> "Recreation Facilities" is hereby repealed. <br /> <br />Section 4: A revised Chapter 13.08 is hereby added to the <br /> Pleasanton Municipal Code, to read as follows: <br /> <br /> "Chapter 13.08 <br /> <br /> Parks and Recreation Facilities <br /> <br /> 13.08.010 Purpose and intent. <br /> <br /> The purpose and intent of this chapter are to <br /> provide rules and regulations respecting the use of <br /> city parks and recreation facilities, which rules <br /> and regulations are necessary to protect the public <br /> health, safety, and general welfare of the <br /> residents of the city and users of parks and <br /> recreation facilities, and which rules and <br /> regulations are felt necessary to insure that the <br /> <br /> -2- <br /> <br /> <br />
