Resolution No. PC-01-58 <br />Page 2 <br /> <br />The granting of the variance will not be detrimental to the public health, <br />safety or welfare, or materially injurious to properties or improvements in <br />the vicinity. <br /> <br />The proposed front yard fence has been in place for a number of years with no <br />detrimental impact on the public health, safety, or welfare. The existing <br />landscaping is sufficient to screen large portions of the fence, which, in <br />conjunction with the proposed 14 ft. setback, reduces its impact on the <br />surrounding neighborhood. <br /> <br />WHEREAS, <br /> <br />the Planning Commission determined not to approve the Groshans' <br />application, but that the existing fence in its present location (a minimum <br />of 14 feet from the front property line at its closest point) is appropriate. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PV-54, a variance from the Pleasanton Municipal Code to <br />allow the present fence to be retained in its current configuration, a <br />minimum of 14-feet from the front property line, located at 668 Abbie <br />Street, subject to the conditions shown in Exhibit "B," attached hereto and <br />made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON ON THE 12TH DAY OF DECEMBER 2001 BY THE <br />FOLLOWiNG VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Arkin, Harvey, Kameny, Maas, and Roberts <br />None <br />Commissioner Sullivan <br />None <br /> <br />ATTEST: <br /> <br />Peggyt4Ez~drg <br />City Clerk <br /> <br />Trish Maas <br />Chairperson <br /> <br />APPROVED AS TO FORM: <br /> <br />Larissa Seto <br />Assistant City Attorney <br /> <br /> <br />
