EXHIBIT "B" <br />Conditions of Approval <br />Case PUD-16 <br /> Applied Biosystems <br /> <br />General Conditions: <br /> <br />Development shall be substantially as shown on the development plans, Exhibit "A", dated "Re- <br />ceived October 15, 2001," on file with the Planning Department, except as modified by the fol- <br />lowing conditions. Minor changes to the plans may be allowed subject to the approval of the <br />Planning Director if found to be in substantial conformance to the approved exhibits. <br /> <br />2. All conditions of Case PUD-98-07 shall remain in full force and effect. <br /> <br />The height of the three-story buildings shall be as shown on the development plan (50 ft. 6 in.). <br />In the event that the PUD modification to allow a maximum building height of 50 ft. 6 in. on the <br />subject site (Case PUD-98-07-1M) is not approved, then the applicants shall reduce the height of <br />the buildings by 2 ft. 6 in. such that the buildings do not exceed an overall height of 48 ft., ex- <br />cluding mechanical equipment screen enclosures. The final design of the three-story buildings <br />shall be submitted in conjunction with the plans submitted for issuance of building permits and <br />shall be subject to the review and approval by the Planning Director prior to issuance of building <br />permits for the project. <br /> <br />The applicants shall obtain all building and other applicable City permits for the project prior to <br />the commencement of construction. <br /> <br />The project developer shall pay any and all fees to which the property may be subject prior to <br />issuance of building permits. The type and amount of the fees shall be those in effect at the time <br />the building permit is issued. <br /> <br />This PUD development plan and design review approval shall lapse and shall become void two <br />years from the date of approval unless a building permit is issued and construction has com- <br />menced and is diligently pursued toward completion or an extension has been approved by the <br />City. The development plan for future phases shall not lapse so long as the initial phase has be- <br />gun. <br /> <br />Prior to issuance of a building permit, the project developer shall pay the required commercial <br />development school impact fee as prescribed by state law and as adopted by the Pleasanton Uni- <br />fied School District. <br /> <br />Conditions of Approval PUD-16 Page 1 <br /> <br /> <br />
