PLANN1NG COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2001-30 <br /> <br />A RESOLUTION RECOMMENDING CERTIFICATION OF THE FINAL <br />ENVIRONMENTAL IMPACT REPORT FOR OAK TREE FARM - PHASE 3, <br />AND RECOMMENDING REMOVAL OF THE GEOTECHNICAL SETBACK <br />LINE <br /> <br />WHEREAS, <br /> <br />Currin Construction Company has submitted an application to certify the <br />final supplemental environmental impact report (FSEIR) for the Oak Tree <br />Farm - Phase 3 developmem plan (PUD-97-01) and to eliminate the <br />geotechnical setback line, commonly referred to as the "Beflogar line," <br />that the City Council established in 1992 when it approved the tentative <br />map for the Oak Tree Farm subdivision; and <br /> <br />WHEREAS, the City of Pleasanton provided proper legal notice of the availability of <br /> the Draft Supplememal Environmental Impact Report (SEIR); and <br /> <br />WHEREAS, the Planning Commission held a public hearing on July 29, 1998 to <br /> receive public comments regarding the Draft Supplemental EIR; and <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton has accepted and responded to comments to the <br />Draft EIR from public agencies having jurisdiction by law, persons having <br />special expertise with respect to any environmental impact involved, and <br />other persons and organizations having an interest in the Project; and <br /> <br />WHEREAS, <br /> <br />the Final Supplemental EIR has been prepared and contains the Draft <br />SEIR, comments and recommendations received on the Draft <br />Supplemental EIR, and the responses to points raised regarding <br />environmental issues in the review and consultation process; and <br /> <br />WHEREAS, the City of Pleasanton has provided proper notice of completion of the <br /> Final Supplemental EIR for the Project; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission held a noticed public heating on June 13, 2001, <br />and considered the completeness and adequacy of the Final Supplemental <br />EIR and the proposal to eliminate the geotechnical setback line; <br /> <br /> <br />
