28. <br /> <br />The homes covered by this approval shall be constructed to encourage <br />telecommuting by providing as an option telecommunications <br />infrastructure consistent with state-of-the-art methods, e.g., cabling for <br />DSL service, wiring for total room access, etc. The project developer <br />shall submit with the first building permit application those measures <br />included in the home construction for review and approval by the Planning <br />Director before issuance of the first building permit. <br /> <br />29. <br /> <br />Only natural gas burning fireplaces or USEPA-approved wood/pellet burning <br />stoves shall be permitted in the proposed houses. <br /> <br />Existing Trees <br /> <br />30. <br /> <br />No trees shall be removed other than those specifically designated for <br />removal in the "Tree Replacement Plan." The project developer shall post <br />cash, letter of credit, or other security satisfactory to the Planning Director <br />in the amount of five thousand dollars ($5,000) for each tree required to be <br />preserved, up to a maximum of twenty-five thousand dollars ($25,000). <br />This cash bond or security shall be retained for one (1) year following <br />acceptance of public improvements or completion of construction, <br />whichever is later, and shall be forfeited if the trees are destroyed or <br />substantially damaged. <br /> <br />31. <br /> <br />Construction of the proposed project could result in the disturbance of <br />active raptor nests, which are protected under California State Fish and <br />Game (CSFG) Code Section Code Section 3503.5. If grading is to begin <br />during the raptor nesting season (February 1 to August 31), a focused <br />survey for raptor nests shall be conducted by a qualified biologist during <br />the nesting season. The survey shall be conducted no less than fourteen <br />(14) days, and no more than thirty (30) days, prior to the beginning of <br />grading and/or tree removal. If nesting raptors are found during the <br />focused survey, no grading or tree removal shall occur within five hundred <br />feet (500' 0") of an active nest until the young have fledged - as <br />determined by a qualified biologist - or until the project developer <br />receives written permission from CSFG personnel to proceed. The written <br />findings of the biologist shall be provided to the Planning Director within <br />thirty (30) days of the start of grading. <br /> <br />Page 14 <br /> <br /> <br />
