CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1421 <br /> <br /> ORDINANCE APPROVING CASE PUD-89-6, THE APPLICATION OF <br /> SPIEKER PARTNERS FOR PUD DEVELOPMENT AND REZONING <br /> <br />WHEREAS, Spieker Partners has applied for Planned Unit <br /> Development rezoning and development plan approval for a <br /> multi-building, approximately 118,500 sq. ft. mixed use <br /> retail/commercial complex to be.located on an <br /> approximately 13.3-acre site located at the northwest <br /> corner of the intersection of Rosewood Drive and Santa <br /> Rita Road; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on June 6, 1989; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed Planned <br /> Unit Development rezoning and development plan; and <br /> <br />WHEREAS, the City Council finds that the proposed Planned Unit <br /> Development rezoning and development plan are consistent <br /> with the General Plan and the purposes of the PUD <br /> Ordinance. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. Approves the rezoning of an approximately 13.3 acre <br /> site located at the northwest corner of the intersection <br /> of Rosewood Drive and Santa Rita Road to the PUD <br /> (Planned Unit Development) - Commercial District. <br /> <br />Section 2. The Zoning Map of the City of Pleasanton dated <br /> April 18, 1960, on file with the City Clerk, designating <br /> and dividing the City into zoning districts is hereby <br /> amended by Zoning Unit Map 374, attached hereto as <br /> Exhibit "A" dated June 6, 1989, and incorporated herein <br /> by reference. <br /> <br />Section 3. Approves the development plan for a multi-building, <br /> approximately 118,500 sq. ft. mixed use <br /> retail/commercial complex to be located on an <br /> approximately 13.3 acre site located at the northwest <br /> corner of the intersection of Rosewood Drive and Santa <br /> Rita Road subject to the conditions shown on Exhibit "B" <br /> attached hereto and made part of this case by reference. <br /> <br /> <br />
