CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1846 AN ORDINANCE APPROVING THE APPLICATION OF MARDEL LLC FOR A MAJOR MODIFICATION TO ALLOW A ONE-YEAR EXTENSION OF AN APPROVED PUD, AS FILED UNDER CASE PUD-99-01-02M WHEREAS, Mardel LLC has applied for a major modification to an approved PUD Plan to allow a one-year extension of the planned unit development (PUD) approval for a new twelve-lot residential subdivision located at 4456 Foothill Road; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - RDR/LDR (Rural Density Residential/Low Density Residential) District and West Foothill Road Corridor Overlay District; and WHEREAS, the property is covered by a Negative Declaration previously adopted for the project; and WHEREAS, Council received the Planning Commission's recommendations for approval of the major modification; and WHEREAS, a duly noticed public heating was held on December 4, 2001; and WHEREAS, the City Council determined that the proposed modification to the approved Planned Unit Development is appropriate. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves Case PUD-99-01-02M, the application of Mardel LLC for a major modification to an approved PUD Plan to allow a one-year extension of the planned unit development approval for a twelve-lot residential subdivision located at 4456 Foothill Road, subject to the conditions set forth on Exhibit B, attached hereto and incorporated herein by this reference. Section 2: A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
