Attachment A <br /> Ordinance No. 1412 <br /> Conditions of Approval <br /> PUD-88-13 <br /> <br />1. That the development plan shall be substantially as <br /> shown on the "Alternate Plan IIb" plans on file with the <br /> Planning Department, with the following modifications: <br /> <br /> a. the hammerhead court design on the southerly court <br /> off of Hillcrest Drive (Perry Lane) shall be <br /> designed to allow no future right-of-way access to <br /> Foothill Road, with lot layout placing private <br /> property between the cul-de-sac end and the <br /> Foothill Road right-of-way; <br /> <br /> b. one lot shall be removed from Palmdale Court, <br /> making the total project size 28 units, with six <br /> lots on Palmdale Court; <br /> <br /> c. minimum side yard setbacks on the easterly sides of <br /> the two lots on Palmdale Court next to existing <br /> residences (Lots 23 and 29) shall be 40 feet; <br /> <br /> and except as otherwise modified by the following <br /> conditions. <br /> <br />2. The developer shall enter into an agreement with the <br /> City to pay for the design and construction of a <br /> soundwall and sidewalk across the Foothill Road frontage <br /> of the project. Said agreement shall be executed by the <br /> developer prior to the submittal of the tentative map. <br /> <br />3. The developer shall dedicate to the City across the full <br /> frontage sufficient right-of-way along Foothill Road to <br /> accommodate a four-lane road with median, as described <br /> in the General Plan, at the time of the filing of the <br /> final map. The right-of-way shall be based upon the <br /> 1972 Precise Alignment, or more recently-adopted <br /> alignment. <br /> <br />4. The developer shall construct public improvements along <br /> the project frontage and along the frontage of the <br /> adjacent property to the south. These improvements <br /> shall include, but not be limited to, curb and gutter, <br /> A.C. pavement tie-in, joint trench, electroliers, storm <br /> drain extension across the full frontage of the <br /> property, and landscaping. <br /> <br /> -1- <br /> <br /> <br />
