GHAD Annual Procedures <br /> After the GHAD is formed, the Council /Board must take a number of steps before it <br /> becomes operational, including passing a budget and levying an assessment. Each <br /> year, before levying the annual assessment, the Board must adopt a resolution <br /> declaring its intention to order that the cost and expenses of maintaining and operating <br /> the district shall be assessed against the properties benefiting thereby. The resolution <br /> is to contain a report setting forth the yearly estimated budget, the proposed <br /> assessments to be levied, and a description of the method used in formulating the <br /> assessments. <br /> After the resolution is adopted, a notice is mailed to all property owners advising them of <br /> the contents of the resolution and advising them of the time, dates and place of the <br /> public hearing when their protests can be heard. At the public hearing, the Board <br /> considers any protests and makes any revisions to the proposed assessments. The <br /> Board may then confirm the assessments and order the levy and collection of the <br /> assessments. <br /> Proposition 218, enacted in the November 1996 general election, complicated the <br /> process for levying the assessments. However, because of the way these four GHADs <br /> were formed, and because the proposed annual assessments are not higher than the <br /> previous year's assessment, other than increases due to an inflation factor (such as a <br /> construction cost index), this year's assessments are in conformance with Proposition <br /> 218. <br /> THIS YEAR'S ASSESSMENTS <br /> Oak Tree Farm <br /> An Engineer's Report for the Oak Tree Farm GHAD has been prepared. It provides that <br /> funding is needed for the following: cleaning of retention basins, site inspection, erosion <br /> stabilization, preparation of the Engineer's Report, and City administrative costs. This <br /> year, the parcel assessment has been increased 6.6 percent for inflation (based on the <br /> April 2009 Engineering News Record Construction Cost Index for the San Francisco <br /> Bay Area), from $258 to $275, including the City -owned sanitary sewer pump station <br /> within the District. (Under Proposition 218, publicly owned property that benefits from <br /> the program is required to pay its fair share.) With 42 properties within the District, <br /> including the City -owned sanitary sewer pump station, this year's budget will be <br /> $11,550. Currently, the Oak Tree Farm GHAD has a fund balance of $40,434. This <br /> reserve is slowly being replenished, as over the last several years the majority of the <br /> reserve funds were used to complete erosion repairs along the fire trail within the <br /> covered area. <br /> Moller Ranch <br /> The Engineer's Report for the Moller Ranch GHAD provides that funding is needed for <br /> the following: excavation and re- compaction of shallow slope failures, installation of <br /> additional subdrain systems, repair of surface drainage improvements, construction of <br /> additional surface drainage improvements, restoration of eroded areas and /or removal <br /> of siltation deposits, site inspection, preparation of the Engineer's Report and City <br /> Page 3 of 5 <br />
