THE CITY OF 2 <br /> GEOLOGIC HAZARD ABATEMENT DISTRICT AGENDA REPORT <br /> pL£ASANTOK <br /> June 16, 2009 <br /> Community Development <br /> Engineering Division <br /> TITLE: ANNUAL ASSESSMENTS FOR THE GEOLOGIC HAZARD ABATEMENT <br /> DISTRICTS (GHADS) FOR OAK TREE FARM, MOLLER RANCH, LAUREL <br /> CREEK ESTATES (THE PRESERVE, OAK HILL ESTATES, AND KOLB <br /> RANCH ESTATES), AND LEMOINE RANCH ESTATES <br /> SUMMARY <br /> A Geologic Hazard Abatement District (GHAD) is a property assessment district that is <br /> used to pay for any landslide repairs and related geologic and storm drainage <br /> monitoring, maintenance and repair work within the District. The City has formed four <br /> GHADs: Oak Tree Farm, Moller Ranch, Laurel Creek Estates (The Preserve, Oak Hill <br /> Estates and Kolb Ranch Estates) and Lemoine Ranch Estates. All are located on the <br /> west side of Foothill Road and are in areas that require annual monitoring and <br /> maintenance of geologic features. This report establishes the proposed annual <br /> assessments to be levied on properties within the Districts for the upcoming tax year. <br /> RECOMMENDATION <br /> 1. Convene as the Board of Directors for the Oak Tree Farm, Moller Ranch, Laurel <br /> Creek Estates (The Preserve, Oak Hill Estates and Kolb Ranch Estates) and <br /> Lemoine Ranch Estates Geologic Hazard Abatement Districts. <br /> 2. Open and hold a Public Hearing to receive comments regarding the levy of annual <br /> assessments for each of the Geologic Hazard Abatement Districts. <br /> 3. Adopt a resolution confirming the assessments and order that the amount of the <br /> assessments be levied against each parcel of property within each district that is <br /> benefited thereby. <br /> 4. Direct the Clerk of the District to record a notice of assessments. <br /> 5. Appropriate $275 from the Sewer Fund (303), and $844 from the Water Fund (305) <br /> to the respective Geologic Hazard Abatement Districts to pay City assessments. <br /> FINANCIAL STATEMENT <br /> Funding of these GHADs will have a minimal financial effect on the City. Because of <br /> Proposition 218, the City now pays a share of the Oak Tree Farm assessment ($275), a <br /> share of the Moller Ranch assessment ($104), and two shares of the Laurel Creek <br /> Estates assessment ($740 annually) due to the City's ownership of parcels of land <br /> within each of these Districts upon which public facilities (such as water tanks and pump <br /> stations) are located. Staffs cost to administer these Districts will continue to be funded <br /> by the assessments. <br />
