Councilmember McGovern questioned whether or not, as indicated by Mr. Wilen's comments, staff <br /> had visited both properties and determined that the lights in question would not be intrusive to either <br /> residence. Mr. Dolan suggested that Mr. Wilen may have overstated that opinion. He said both <br /> homes are set back from Foothill Road and separated by some vegetation. Staff proposed to install <br /> an LED bulb which does not extend below the light's cover and would not shine directly into either <br /> home but would create general light and, perhaps, interfere with the area's character. <br /> Mr. Fialho advised the Council that any voting majority member can move to reconsider the item. <br /> Staff would reschedule it for a later date and provide the Council with options and a recommended <br /> resolution. <br /> Councilmember McGovern confirmed that desire. <br /> Vice -Mayor Cook Kallio said she had imagined some sort of consensus would be reached and <br /> never envisioned that this would result in either side becoming so entrenched. She asked staff to <br /> provide traffic and accident statistics for the area and said she will drive the area at night herself. <br /> Vice -Mayor Cook Kallio asked staff to include information on setbacks and light cones. <br /> City Engineer Jim Kelcourse explained that the LED lighting used for these standards utilize <br /> individual bulbs which allow control of the lighting's direction such that it will project only on the <br /> roadway. He noted that the two residents in question have expressed opposition even to indirect <br /> lighting. <br /> MOTION: It was m/s by Sullivan /Cook Kallio to reconsider the City Council's decision of April 7, <br /> 2009 concerning the reinstallation of 18 streetlights along Foothill Road. Motion passed by the <br /> following vote: <br /> Ayes: Councilmembers Cook Kallio, McGovern, Sullivan, Mayor Hosterman. <br /> Noes: None <br /> Absent: Councilmember Thorne <br /> Mr. Fialho advised that the item would not return before the Council until sometime in late June or <br /> early July. <br /> Councilmember Sullivan questioned whether or not there was any interest in revising or at least <br /> reviewing the IZO to cover issues like that considered this evening. <br /> Vice -Mayor Cook Kallio said she would not mind reviewing it, but that tonight's applicant was <br /> excluded from the IZO because of the unit threshold and because it is an older unit. <br /> Mr. Roush advised the Council that one of the difficulties in negotiating this item with the developer <br /> is the result of new State legislation which attempts to limit the amount of discretion that local <br /> agencies have over these types of infill developments. He agreed to renegotiate with this developer <br /> as well as address any issues with the IZO but asked the Council to keep this in mind. <br /> Vice -Mayor Cook Kallio cautioned against amending the IZO to be so restrictive that it discourages <br /> infill development. <br /> Councilmember McGovern noted that the City is preparing to develop a new Housing Element, <br /> making this an opportune time to review the IZO.
