To date, the City has adopted all but the Commercial and Demolition Debris Ordinance. <br /> As a result, staff is recommending introduction of the ordinance. <br /> DISCUSSION <br /> While the City has not formally adopted a C &D ordinance, the Planning Commission <br /> approved a draft ordinance in 2002 and as a result, staff has been informally using this <br /> as a template for administering recycling standards for construction and demolition jobs <br /> and many planning conditions of approval refer to recycling standards set for in the draft <br /> ordinance. <br /> Upon being notified of the Authority's new Import Mitigation funding requirements, staff <br /> assembled a team comprised of representatives from the building, planning and law <br /> operations to review the ordinance. The end result was a few minor changes to the <br /> ordinance adopted by the Planning Commission. Further, staff presented the ordinance <br /> to the Authority and Pleasanton Garbage Service for their review and their comments <br /> have been incorporated in the proposed ordinance. <br /> In summary, the ordinance establishes the following: <br /> Applies to construction jobs with a total value in excess of $125,000 <br /> Applies to demolition jobs with a total value in excess of $25,000 <br /> Requires 90% of Portland Cement Concrete and at least 50% of remaining <br /> construction debris to be recycled <br /> Requires the applicant to identify what material will be generated and what will be <br /> recycled <br /> Recyclable material includes nonhazardous material and byproducts such as wood, <br /> textiles, glass, metal, rubber, concrete, carpeting, etc. <br /> Does not stipulate methods for recycling as this remains the option of applicant <br /> Does not conflict with the City's refuse and recycling franchise with Pleasanton <br /> Garbage Service meaning, drop boxes are still covered by the franchise <br /> If the City Compliance Official determines that a good faith effort was made but the <br /> recycling target was not met, he /she may approve the application <br /> Allows for exemption for unusual circumstances if recycling is infeasible <br /> City will not issue an occupancy permit if recycling requirements are not met <br /> Allows for an appeal to the City Manager <br /> Page 3 of 4 <br />
