PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2376 <br />A RESOLUTION OF THE CITY OF PLEASANTON APPROVING A <br />CONDITIONAL USE PERMIT FOR A MODEL HOME COMPLEX FOR <br />HOWARD MARK COMPANY AS FILED UNDER CASE UP -83 -43 <br />WHEREAS, Howard Mark Company has applied for a conditional use permit <br />to allow the operation of a model home complex consisting <br />of 6 model homes, an existing office and related facilities <br />on Monaco Court in the Mission Hill development located <br />north and east of Sunol Boulevard /Mission Drive intersection; <br />and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />Medium Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of October 26, 1983 <br />after hearing all public testimony, recommendations of the <br />City staff and relevant documents, the Planning Commission <br />found a) that the proposed location of the conditional use <br />is in accord with the objectives of the zoning ordinance <br />and the purposes of the district in which the site is located; <br />b) that the proposed location of the conditional use and <br />the conditions under which it would be operated or maintained <br />will not be detrimental to the public health, safety or <br />welfare or be materially injurious to properties or improvements <br />in the vicinity; and c) that the proposed conditional use <br />will comply with each of the applicable provisions of the <br />zoning ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approvescase UP- 83 -43, application of Howard Mark Company <br />for a conditional use permit to operate a model home complex <br />on Monaco Court in the Mission Hill project subject to the <br />conditions shown on Exhibit "A" attached hereto and made <br />part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption or on the day after notification <br />to City Council unless appealed. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />ON THE 26TH DAY OF OCTOBER 1983 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Doherty, Getty, Lindsey, Wilson and Chairman <br />Jamieson <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />DATE: October 26, 1983 <br />
