PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2371 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON RECOMMENDING AMENDMENTS TO <br />CERTAIN PROVISIONS OF CHAPTER 2, TITLE II OF THE <br />ORDINANCE CODE OF THE CITY OF PLEASANTON WITH <br />REGARD TO OUTDOOR SALES AS FILED UNDER CASE RZ -83 -6 <br />WHEREAS, the City of Pleasanton has applied to amend certain provisions <br />of Chapter 2, Title II of the Ordinance Code of the City <br />of Pleasanton with regard to outdoor sales; and <br />WHEREAS, at their duly noticed public hearing of October 12, 1983 <br />the Planning Commission considered all public testimony, <br />relevant documents and recommendations of the City staff; <br />WHEREAS, the Planning Commisson concurred with the wording provided <br />in the staff report dated October 12, 1983. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Recommends an amendment to Section 2- 7.07(b) to make <br />provision for "decorative" outdoor displays on private <br />commercially zoned property. The following is wording <br />which should be added as subparagraph 3 of that section: <br />Outdoor "decorative" displays for the purpose of enhancing <br />the appearance of a structure or site, occupying no <br />more than 50 sq. ft. and not located in a public right -of -way <br />or in any required parking area, will be allowed by <br />the Zoning Administrator upon making the finding that <br />such displays are not detrimental to the public health, <br />safety or general welfare. Such displays shall not <br />contain signing (unless they are submitted as a sign). <br />The Zoning Administrator's decision with regard to <br />what constitutes a decorative display may be appealed <br />to the Design Review Board by the effected merchant <br />or property owner. The requirements of Section 2 -5.11 <br />of the Code shall not govern such an appeal. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoptin. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />ON THE 12TH DAY OF OCTOBER 1983 BY THE FOLLOWING VOTE: <br />AYES: Commissioner Doherty, Getty, Lindsey and Chairman Jamieson <br />NOES: None <br />ABSENT: Commissioner Wilson <br />ABSTAIN: None <br />
