PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 2367 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON APPROVING A USE PERMIT FOR HONEY TREAT YOGURT AS FILED UNDER CASE UP -83 -37 WHEREAS, Honey Treat Yogurt has applied for a conditional use permit to maintain four amusement devices (video games) as part of a restaurant at 929 Main Street; and WHEREAS, zoning for the property is C -C (Central Commercial) District; and; WHEREAS, at their duly noticed public hearing of October 12, 1983 the Planning Commission considered all public testimony, relevant exhibits and recommendations of the City Staff; and WHEREAS, the Planning Commission found a) that the proposed location of the conditional use is in accord with the objectives of the chapter and the purposes of the district in which the site is located; b) that the proposed location and conditions under which it would be operated or maintained will not be detrimental to the public health, safety or wwelfare or be materially injurious to properties or improvements in the vicity; and c) that the proposed conditional use will comply with each of the applicable provisions of the ordinance code. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves case UP -83 -37 as filed by Honey Treat Yogurt Shoppe subject to the following conditions: 1. That this use permit is granted for a maximum of four (4) video game machines to be located solely at the business located at 929 -A Main Street. 2. That a bicycle rack containing at least 6 stalls shall be placed adjacent to the building in a location that will not block traffic. 3. That this use permit is subject to all standards contained in Section 4 -4.25, Article 11, Chapter 2, Title IV of the Ordinance Code of the City of Pleasanton. Section 2 This resolution shall become effective 15 days following October 12, 1983 or on the day following the next meeting of the Council, whichever is later, unless an appeal has been taken to the Council, or unless the Council shall elect to review the decision of the Planning Commission.
