PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2359 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON APPROVING A MINOR MODIFICATION TO <br />A USE PERMIT FOR JAMES CROSS AS FILED UNDER CASE <br />UP- 82 -24 -1M <br />WHEREAS, James Cross has applied for a minor modification of a <br />conditional use permit to operate an automotive service <br />facility at 44 Mission Drive; and <br />WHEREAS, zoning for the property is CF (Commercial Freeway) District; and <br />WHEREAS, the Planning Commission considered all public testimony, <br />relevant documents and recommendations of the City Staff <br />at their duly noticed public hearing of September 18, 1983. <br />NOW, THEREFORE THE PLANNING COMMISISON OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP- 82- 24 -1M, application of James Cross <br />for a modification of a conditional use permit to operate <br />an automotive service facility at 44 Mission Drive <br />subject to the following conditions: <br />1. That condition #7 of UP -82 -24 be amended to read as <br />follows: <br />That there shall be no outdoor repair or maintenance of <br />vehicles on the premises at any time except for the operation <br />of a single wheel alignment rack no greater than 17" <br />in height under the front canopy. Vehicles aligned on <br />the rack shall be immediately removed after servicing <br />and all movable parts of the rack including approach <br />ramps, and other apparatus shall be removed during <br />non business hours and stored indoors. <br />2. That except for the modification of condition #7 this <br />approval is subject to all remaining conditions of <br />UP- 82 -24. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption or on the day following the next meeting <br />of the Council whichever is later unless appealed. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />ON THE 28TH DAY OF SEPTEMBER 1983 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Arrigoni, Getty, Lindsey and Chairman Jamieson <br />NOES: None <br />ABSENT Commissioners Doherty and Wilson <br />ABSTAIN: None <br />
