DATE: September 28, 1983 <br />PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2357 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON APPROVING A USE PERMIT <br />FOR HOWARD MARK COMPANY AS FILED UNDER CASE <br />UP -83 -33 <br />WHEREAS, Howard Mark Company has applied for a conditional use permit <br />to operate a model home sales complex and related facilities <br />at the terminus of Sorrel Downs Court in the Foothill <br />Knolls subdivision located on the east side of Foothill <br />Road opposite Santos Rancho Road; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />Low Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of September 28, 1983 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff; and <br />WHEREAS, the Planning Commission found that a) the proposed location <br />of the conditional use is in accord with the objectives <br />of the zoning ordinance and the purposes of the district in <br />which the site is located; b) that the proposed location of <br />the conditional use and the conditions under which it would <br />be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity; and c) <br />that the proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP- 83 -33, application of Howard Mark Company <br />as herein described subject to the conditions shown on <br />Exhibit "A attached hereto and made part of this case <br />by reference. <br />Section 2. This resolution shall become effective 15 days after its <br />passage and adoption or on the day following the next meeting <br />of the Council whichever is later unless appealed. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />ON THE 28TH DAY OF SEPTEMBER 1983 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Arrigoni, Getty,Lindsey and Chairman Jamieson <br />NOES: None <br />ABSENT: Commissioners Doherty and Wilson <br />ABSTAIN: None <br />
