PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2352 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON APPROVING A CONDITIONAL USE <br />PERMIT FOR MICHAEL AND AVA DALEY AS FILED UNDER <br />CASE UP -83 -28 <br />WHEREAS, Michael and Ava Daley have applied for a conditional <br />use permit to operate an off -set printing and <br />copying service at 344 Division Street; and <br />WHEREAS, zoning for the property is C -C (Central Commercial) <br />District; and <br />WHEREAS, at their duly noticed public hearing of September 14, 1983 <br />the Planning Commission considered all relevant documents, <br />public testimony and recommendations of the City staff; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use is in accord with the objectives <br />of the Ordinance Code and the purposes of the district <br />in which the site is located; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use and the conditions under which it <br />would be operated or maintained would not be detrimental <br />to the public health, safety or welfare, or be materially <br />injurious to properties or improvements in the vicinity; and <br />WHEREAS, the Planning Commission found that the proposed conditional <br />use will comply with each of the applicable provisions <br />of the Ordinance Code. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP -83 -28 as herein described subject to <br />the following conditions: <br />1. That this use permit is granted only for the property <br />known as 344 Division Street and that the printing service <br />shall occupy only the western half of the front building <br />on that site and shall occupy no more than approximately <br />800 sq. ft. of the building. <br />2. That within thirty (30) days of the effective date <br />of this use permit, the owner of the property known <br />as 344 Division Street shall enter into an agreement <br />with the City agreeing not to protest the establishment <br />of a parking assessment district if one is established <br />for the area bounded by Division Street, Main Street, <br />Rose Avenue and Peters Avenue. <br />
