PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2344 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING A USE PERMIT FOR KATIE NICHOLSON <br />AS FILED UNDER CASE UP -83 -27 <br />WHEREAS, Katie Nicholson has applied for a conditional use permit <br />to allow the installation and operation of an ice vending station <br />at the northeast corner of Neal Street and Railroad Avenue; and <br />WHEREAS, zoning for the property is C -C (Central Commercial) District; and <br />WHEREAS, at their duly noticed public hearing of August 24, 1983 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City Staff; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purposes of the district in <br />which the site is located; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental <br />to the public health, safety, or welfare, or materailly <br />injurious to the properties or improvements ini the <br />vicinity; and <br />WHEREAS, the Planning Commission found that the proposed conditional <br />use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />HEREBY RESOLVES THE FOLLOWING: <br />Section 1. Approves the application of Katie Nicholson for <br />a conditional use permit to allow the installation <br />and operation of an ice vending station at the northeast <br />corner of Neal Street and Railroad Avenue as filed under <br />case UP -83 -27 subject to conditions shown on Exhibit A <br />attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption or the day after the next <br />City Council meeting whichever is later. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />ON THE 24TH DAY OF AUGUST 1983 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Doherty, Getty, Lindsey, Wilson and <br />Chairman Jamieson <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />
