WHEREAS, WHEREAS, WHEREAS, PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 2342 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON APPROVING A USE PERMIT FOR SHERROD MARSHALL ASSOCIATES FOR BLACK ANGUS AS FILED UNDER CASE UP -83 -24 WHEREAS, Saga Properties and Sherrod Marshall Associates have applied for a conditional use permit to operate a game arcade within a restaurant facility (.Black Angus Restaurant) located north of the intersection of Canyon Way and Stoneridge Mall Road; and zoning for the property is CR (Regional Commercial) District; and at their duly noticed public hearing of August 10, 1983 the Planning Commission considered all public testimony, relevant exhibits and recommendations of City staff; and the Planning Commission found that the proposed location of the conditional use is in accord with the objectives of the chapter of the zoning ordinance concerning the purposes of the district in which the site is located; and WHEREAS, the Planning Commission found that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity; and WHEREAS, the proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves case UP -83 -24 for a video game arcade in the Black Angus Restaurant located at 5937 Stoneridge Mall Road subject to the following conditions: 1. That the use permit is granted only for two commercial amusement devices in the Black Angus Restaurant located at 5937 Stoneridge Mall Road. 2. That the amusement devices shall be operated in accordance with the standards set forth in Section 4 -4.25, Article 11, Chapter 2, Title IV of the Ordinance Code of the City of Pleasanton, attached hereto and made part of this case by reference.
