That the developer shall comply with all the requirements of Chapter 15, <br />Title II, of the Ordinance Code of the City of Pleasanton (Condominium <br />Conversion Projects). <br />3. That all units shall comply with all codes and ordinances in effect at the time <br />of occupancy as condominium units as determined by the Chief Building Inspector. <br />4. That the CC &Rs for the development shall be submitted to and approved by <br />the City Attorney's office prior to issuance of building permits. Said <br />CC &Rs shall provide for a homeowners association of sufficient strength to <br />properly maintain the property at all times. <br />5. That the developer shall submit an on -site existing utility plan prior to <br />recording a final map; <br />6. That prior to the filing of a final map, the developer shall execute and <br />record an agreement incorporating the terms and conditions of the conversion <br />approval binding the developer and any successor in interest to provide <br />the assistance to tenants and to improve the project in accordance with <br />Chapter 15, Title II of the Ordinance Code of the City of the City of <br />Pleasanton. This agreement shall be recorded and a copy shall he provided <br />to each tenant occupying a unit on the date of approval of the condominium <br />conversion project. The agreement shall run to the benefit of any tenant <br />occupying a unit on the date of approval of the condominium conversion <br />project and may require bonds to assure the completion of improvements in <br />accordance with project approval; <br />7. That an 8' PSE be maintained across the frontage of the property; <br />8. That the developer be advised that upon recordation of the final neap sewer <br />service charges shall be adjusted to the rate imposed for single fan <br />units for each dwelling in the project. <br />9. That any existing damage to public improvements or any damages resulting from <br />conversion shall be repaired as determined by the City Engineer by and at <br />the full expense of developer. <br />10. That all cosmetic improvements including but not limited to painting of <br />structures and refurbishment of planted areas, or any patching and repair of <br />paved areas shall be approved by the Planning Division prior to recordation <br />of the final map. <br />
