Vice Mayor Cook-Kallio said she did not understand it as fully as she would like, appreciates the <br />fact that the applicant has answered many of the questions, but she has the benefit of a staff report <br />and people to whom she can ask questions. She asked the park owner and his representative to <br />work with the City and if this is truly a benefit, this should be communicated to residents. In addition, <br />she also thinks that there are ways to construct a survey and asked for the owner to help the <br />Council and residents understand the issues so that the best decision possible can be made. <br /> <br />Mayor Hosterman agreed with Council comments. There seems to be some grey area regarding <br />the definition of a bona fide survey and because of this, she did not believe the process was carried <br />out as well and as fully as it could have been, which is obvious from the results. She thinks it is <br />important to continue the public hearing to another date when the Council is able to receive a truly <br />bona fide survey, and to have staff provide input into the formation of the survey so that it is <br />understandable, that it elicits answers from residents such that the Council can then rely upon that <br />information to make a decision. She pointed out that the application is not being denied, but the <br />Council finds it does not have enough information and the Council does not believe residents had <br />the benefit of having enough information as well. She also wanted the City to do what it can to <br />influence state legislation on the issue. She said perhaps the Sonoma case will be adjudicated in <br />the near future, which would provide additional information with which to make a decision. <br /> <br />MOTION: It was M/S by Cook-Kallio/Thorne (1) to continue the item; (2) to direct staff to work with <br />the park owner and his representatives (a) to prepare an informational packet about the conversion <br />that would be provided to the residents, (b) to conduct appropriate outreach to the residents to <br />answer their questions and concerns about the conversion and (c) to prepare a revised survey <br />that the residents would complete and return to the City, after which this item would be returned to <br />the Council for a decision; (3) to support legislation to strengthen local control over mobilehome <br />conversions; and (4) support other public entities’ litigation efforts to exercise more land use control <br />over mobilehome conversions.. Motion passed by the following vote: <br /> <br />Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br />Noes: None <br />Absent: None <br /> <br />BREAK: <br />Mayor Hosterman called for a 3-minute break and thereafter reconvened the regular City <br />Council meeting. <br /> <br />Continued to May 19, 2009 <br />14. – Consideration of a resolution establishing an irrevocable trust, <br />related documents and an interim investment strategy, for the purpose of pre-funding retiree <br />medical benefits <br /> <br />15. Consideration of a resolution requesting Pleasanton Water Customers voluntarily reduce their <br />water demand by 20% during the calendar year 2009 <br /> <br />Mayor Hosterman noted the City is in its third year of a serious drought, in a regulatory drought, and <br />are also experiencing a crashing of the ecology of the Delta. <br /> <br />Operations Services Director, Daniel Smith said staff requests Council approve a resolution for a <br />20% voluntary water conservation request, said the State’s water supply is in drought and the driest <br />it has been in 80 years. In February 2009, the Governor declared a drought state of emergency for <br />California which was a clear message to take action. He said 80% of the City’s water supply comes <br />from Zone 7, which affects areas that it provides water to. The main concern is the Department of <br />Water Resources, as in January they indicated the City would receive 20% of its normal allocation, <br />which has been elevated to 30%; however, this is far less than what the City would normally <br /> <br />City Council Minutes Page 14 of 17 May 5, 2009 <br /> <br /> <br />
