CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> ORDINANCE NO. 1442 <br /> ORDINANCE APPROVING A DEVELOPMENT PLAN FOR FRED <br /> HEMPY AS FILED UNDER CASE PUD-88-16 <br /> WHEREAS, Fred Hempy has applied for development plan approval to <br /> construct a four-parcel single-family residential <br /> project to be located on an approximately four acre site <br /> located at 5226 Foothill Road; and <br /> WHEREAS, zoning for the property is PUD (Planned Unit <br /> Development) - Low Density Residential District; and <br /> WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on <br /> November 21, 1989; and <br /> WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the <br /> proposed single-family residential development; and <br /> WHEREAS, the City Council finds that this development plan is <br /> consistent with the PUD zoning district and General Plan <br /> policies. <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> Section 1. Approves Case PUD-88-16, the application of Fred <br /> Hempy for development plan approval to construct a four- <br /> parcel single-family residential project to be located <br /> on an approximately four acre site at 5226 Foothill Road <br /> subject to the conditions shown on Exhibit "A" attached <br /> hereto. <br /> Section 2. This ordinance shall be published once within fifteen <br /> (15) days after its adoption in "The Tri-Valley Herald," <br /> a newspaper of general circulation published in the City <br /> of Pleasanton. <br /> Section 3. This ordinance shall be effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> INTRODUCED at a regular meeting of the City Council of the City <br /> of Pleasanton on the 21st day of November 1989. <br /> -1- • <br />
