CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE N0. 1441 ORDINANCE APPROVING A MAJOR MODIFICATION AND DESIGN REVIEW APPROVAL FOR DELTA PROPERTIES/HOME DEPOT AS FIT~D UNDER CASE PUD-89-16 WHEREAS, Reynolds and Brown has applied for a major modification and design review approval for a 155,096 sq. ft. mixed use retail center which includes a 101,880 sq. ft. home improvement store, 49,350 sq. ft. of ancillary retail and a future 3,500 sq. ft. drive-thru restaurant located at the northwest corner of Owens Drive and Johnson Drive; and WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by Council on November 7, 1989; and WHEREAS, Council received the Planning Commission's recommendations for approval of the proposed major modification and design review application; and WHEREAS, the City Council finds that this proposed PUD modification and development plan are consistent with the General Plan and the purposes of the PUD ordinance. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Approves a major modification for the approximately 13.6 acre site located in Pleasanton Park at the northwest corner of Owens and Johnson Drives to allow uses as shown in the C-C (Central Connnercial) District in the City's Municipal Code except that home improvement centers and garden centers shall be additional permitted uses, and that residential uses shall not be allowed. Section 2. Approves the design of the Home Depot retail complex to be located on the 13.6 acre site in the Pleasanton Park at the northwest corner of Owens Drive and Johnson Drive subject to the conditions shown on Exhibit"'A", attached hereto and made part of this case by reference. Section 3. This ordinance shall be published once within fifteen (15) days after its adoption in "The Tri-Valley Herald," a newspaper of general circulation published in the City of Pleasanton. -1-
