CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1452 <br /> <br /> ORDINANCE APPROVING A MAjOR MODIFICATION TO AN <br /> APPROVED PLANNED UNIT DEVELOPMRNTAS FILED BY <br /> GEORGE MARMENTUNDERCASE PUD-85-20-3M <br /> <br />WHEREAS, George Marment has applied for a major modification to <br /> an approved planned unit development for conversion of <br /> 12 apartments located at 50 Peters Avenue into 12 <br /> condominiums; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed major <br /> modification; and <br /> <br />WHEREAS, the City Council made the following findings: <br /> <br /> Although the project does not meet the Code requirements <br /> for condominium parking spaces, special circumstances <br /> warrant a relief for this project. The current tenancy <br /> of the apartment complex have not been faced with any <br /> on-site parking shortage. In the event that <br /> supplemental parking is needed, a generous amount of <br /> street parking is available in close proximity. This <br /> modification is not a change in policy for condominium <br /> standards, but rather a special consideration for this <br /> project due to extenuating circumstances. <br /> <br />WHEREAS, this project is categorically exempt (Class 5) from the <br /> CEQA. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. Approves the application of George Marment for a <br /> major modification to an approved development plan for a <br /> 12-unit residential apartment complex to provide for the <br /> elimination of a previously-required access easement and <br /> seven parking spaces subject to the following <br /> conditions: <br /> <br /> 1. That the development shall be substantially as <br /> shown on Exhibit A, dated received December 11, <br /> 1989 on file with the Planning Department. <br /> <br /> 2. That the development is subject to all conditions <br /> of approval for PUD-85-20. <br /> <br /> <br />
