CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1462 <br /> <br /> ORDINANCE APPROVING A DEVELOPMENT PLAN TO <br /> CONSTRUCT AN UNDERGROUND TANK, TRUCK STORAGE <br /> YARD AND RELATED IMPROVEMENTS AS FILED BY ~T~. <br /> AMERICAN OIL, PUD-90-04 <br /> <br />WHEREAS, Jim Gentile/All American Oil Company has applied for <br /> development plan approval to construct an underground <br /> tank, truck storage yard and related improvements to be <br /> located at 3100 Valley Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit <br /> Development) - Industrial District; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on April 11, 1990; <br /> and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed development <br /> plan; and <br /> <br />WHEREAS, the City Council made the following findings: <br /> <br /> A. The proposed plan is in the best interests of the <br /> public health, safety, and general welfare. <br /> <br /> The proposed site has been zoned for an industrial <br /> use in accordance to the General Plan. The <br /> business will relocate from a residentially zoned <br /> property in the downtown area to an area <br /> characterized by industrial users. The facility <br /> will utilize state-of-the-art tank and monitoring <br /> systems to ensure safe operation. With the <br /> installation of the double-walled tank and <br /> monitoring systems, staff feels this finding can be <br /> made. <br /> <br /> B. The proposed plan is consistent with the City's <br /> General Plan. <br /> <br /> C. The plan is compatible with the previously <br /> developed properties in the vicinity and the <br /> natural topographical features of the site. <br /> <br /> -1- <br /> <br /> <br />
