CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1461 <br /> <br /> ORDINANCE APPROVING A MAJOR MODIFICATION TO AN <br /> APPROVED PUDAS FILED UNDER CASE <br /> PUD-80-15-5D-1M <br /> <br />WHEREAS, the City of Pleasanton has applied for a major <br /> modification to an approved planned unit development <br /> ("Measure X"; PUD-80-15-5D-1M) to delete "restaurants, <br /> and soda fountains, including drive-in and take-out food <br /> establishments" from the list of conditional uses in <br /> PUD-80-15-5D, a retail commercial development located at <br /> the southeast corner of Pimlico Drive and Santa Rita <br /> Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit <br /> Development) - Commercial District; and <br /> <br />WHEREAS, the current status regarding fast food restaurants <br /> within PUD-80-15-5D is unclear due to an inconsistency <br /> between the conditions of approval and the ballot <br /> argument. <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed major <br /> modification; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1. Approves deleting "restaurants and soda fountains, <br /> including drive-in and take-out food establishments" <br /> from the list of conditional uses for PUD-80-15-5D. <br /> <br /> Section 2. This ordinance shall be published once within fifteen <br /> (15) days after its adoption in "The Tri-Valley Herald," <br /> a newspaper of general circulation published in the City <br /> of Pleasanton. <br /> <br /> Section 3. This ordinance shall be effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> <br /> INTRODUCED at a regular meeting of the City Council of the City <br /> of Pleasanton on May 1, 1990. <br /> <br /> <br />
