20. The applicant shall provide all homebuyers with a copy of the <br /> <br /> prepared during the course of project review and <br /> construction. <br /> <br />21. All utilities to the individual units shall be served by a <br /> single common privately maintained line within the on-site <br /> roadway. There shall be one common water meter for all the <br /> units which shall be located in the public service easement <br /> along Kottinger Drive. The applicant may, at his option, <br /> install private individual water meters to each house. <br /> <br />22. All individual down spouts shall be connected to a storm <br /> drain system. The 8-inch on-site storm water drain pipe that <br /> picks up water from the V-ditch at the rear of the lots shall <br /> be connected to the new storm drain on Kottinger Drive. <br /> <br />23. The homeowners association shall enter into an agreement with <br /> the City to hold harmless, defend, and indemnify the City, <br /> its officers, and employees from any cause of action or claim <br /> for damage or injury caused by the private driveway, slope <br /> banks, or private utilities, or their maintenance or upkeep, <br /> or caused by the party contracted with for their maintenance <br /> services. The CC&R's shall make each homeowner chargeable <br /> for costs related to responsibilities provided for in this <br /> condition. In addition, the agreement shall appropriately <br /> protect the City against landslides and subsidence claims <br /> which may be the result of constructing this project on a <br /> hillside location. This agreement shall be subject to the <br /> approval of the City Attorney and shall be finalized prior to <br /> approval of the final map. <br /> <br /> -6- <br /> <br /> <br />
