CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1467 <br /> <br /> ORDINANCE APPROVING THE APPEAL AS FILED UNDER <br /> CASE AP-90-4 AND APPROVING CASE PUD-90-2 AS <br /> FILED BY MICHAEL GORDON <br /> <br />WHEREAS, Michael Gordon appealed a decision of the Planning <br /> Commission denying approval of Case PUD-90-2, the <br /> application for planned development rezoning and <br /> development plan approval for a five-lot residential <br /> PUD, including the development of four new single family <br /> residences; and <br /> <br />WHEREAS, zoning for the property is R-1-6500 (Single-family <br /> Residential) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, Michael Gordon submitted an appeal to the City <br /> Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, a public hearing was held before the City Council on <br /> June 5, 1990 at which time all pertinent testimony and <br /> documents were reviewed; and <br /> <br />WHEREAS, based on the preponderance of evidence, the City <br /> Council finds that this appeal should be upheld and the <br /> application for rezoning and development plan should be <br /> approved based on the following findings: <br /> <br /> A. The plan is in the best interests of the public <br /> health, safety, and general welfare: <br /> <br /> The project has been designed and conditioned to <br /> avoid excessive grading and to blend in with the <br /> surrounding area. The required geotechnical study <br /> has been prepared and reviewed and the conclusion <br /> is that the site is capable of being safely <br /> developed if the recommendations of the <br /> geotechnical con~ultantz are followed. <br /> <br /> B. The plan is consistent with the City's General <br /> Plan: <br /> <br /> At 2.5 dwelling units per acre, the proposed <br /> project density is consistent with the Land Use <br /> Element of the General Plan, which allows a density <br /> range of 2-8 dwelling units per acre. In addition, <br /> the density would be well below the average density <br /> of 5 dwelling units per acre, meaning that a PUD <br /> without the provision of amenities is appropriate. <br /> <br /> <br />
