CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1475 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF RETAIL <br /> PROPERTY DEVELOPMENT AS FILED UNDER CASE PUD-85-8-4D-1M <br /> <br />WHEREAS, Retail Property Development has applied for a major <br /> modification to an approved development plan for a <br /> retail commercial complex to allow for a reduction of <br /> overall square footage for the complex, a <br /> reconfiguration of the corresponding parking and <br /> landscape areas, and the addition of an outdoor dining <br /> area to the freestanding restaurant pad to be located on <br /> an approximately 3.16 acre site located on the north <br /> side of Owens Drive approximately 400 feet east of the <br /> intersection of Chabot Drive and Owens Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit <br /> Development) - Industrial, Commercial and Offices <br /> District; and <br /> <br />WHEREAS, at their duly noticed public hearing of July 17, 1990 <br /> the City Council considered all public testimony, <br /> relevant exhibits, and recommendations of the City <br /> staff; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from <br /> the requirements of CEQA; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed <br /> modifications; and <br /> <br />WHEREAS, the City Council finds that this proposal is in <br /> conformance with the approved PUD and General Plan <br /> designation of the subject site. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. Approves Case PUD-85-8-4D-1M, the application of <br /> Retail Property Development has applied for a major <br /> modification to an approved development plan for a <br /> retail commercial complex to allow for a reduction of <br /> overall square footage for the complex, a <br /> reconfiguration of the corresponding parking and <br /> landscape areas, and the addition of an outdoor dining <br /> area to the freestanding restaurant pad to be located on <br /> an approximately 3.16 acre site located on the north <br /> side of Owens Drive approximately 400 feet east of. the <br /> intersection of Chabot Drive and Owens Drive subject to <br /> the conditions shown on Exhibit "B" attached hereto and <br /> made part of this case by reference. <br /> <br /> <br />
