CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1472 ORDINANCE APPROVING DEVELOPMENT AGREEMENT WITH CROCKER PROPERTIES, INC. WHEREAS, Government Code Section 65864 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, Mozart Development Company and Wells Fargo Bank have made application to the City to enter into such an agreement provided for in the Government Code in conjunction with its application for approval of a development plan; and WHEREAS, after public notice, the Planning Commission held a hearing and recommended approval of the development agreement as proposed; and WHEREAS, at its meeting of June 19, 1990, the City Council reviewed the staff report from the Director of Planning and Community Development (SR 90:253) together with copies of staff reports to the Planning Commission regarding this matter; and WHEREAS, on June 19, 1990, a duly noticed public hearing was held at which time the applicant and all other members of the public were offered an opportunity to present evidence regarding this development agreement; and WHEREAS, based on the Initial Environmental Study indicating no significant adverse effects on the environment, a negative declaration was adopted by the Council on June 19, 1990; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Finds that the proposed Development Agreement is consistent with the City's General Plan. Section 2: Approves the Development Agreement, a copy of which can be reviewed at the City Clerk's Office, 123 Main Street, Pleasanton, California.
