CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1471 <br /> <br /> AN ORDINANCE APPROVING A MAJOR MODIFICATION TO PUD- <br /> 81-22 AND APPROVING FINAL DEVELOPMENT PLAN FOR A <br /> 604,750 SQ. FT. FIVE-BUILDING, FIVE-STORY OFFICE <br /> COMPLEX AND RELATED USES INCLUDING A MELIPAD ATOP <br /> ONE BUILDING AND A POTENTIAL CHILD CARE CENTER <br /> (PUD-81-22-6M) (AP-90-7) <br /> <br />WHEREAS, at its meeting of May 23, 1990, the Planning <br /> Commission denied the application of Mozart/Wells <br /> Fargo Bank for a major modification (PUD-81-22-6M) <br /> to an approved development plan and final <br /> development plan approval for a 604,750 sq. ft. <br /> five-building, five-story office complex and <br /> related uses; ancillary uses include a helipad atop <br /> one building and a potential child care center; <br /> and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the applicant submitted an appeal <br /> to the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, at its meeting of June 19, 1990, the City Council <br /> reviewed the staff report from the Director of <br /> Planning and Community Development (SR 90:253) <br /> together with copies of staff reports to the <br /> Planning Commission regarding this matter; and <br /> <br /> WHEREAS, a duly noticed public hearing was held at which <br /> time the applicant and all other members of the <br /> public were offered an opportunity to present <br /> evidence regarding this appeal; and <br /> <br /> WHEREAS, based on the Initial Environmental Study, a <br /> negative declaration was adopted by Council on <br /> June 19, 1990; and <br /> <br /> WHEREAS, the City Council finds that this major modification <br /> and development plan is consistent with the General <br /> Plan policies of the City of Pleasanton and <br /> incorporates sufficient amenities and mitigations <br /> to justify the increase in floor area ratio (FAR) <br /> above the "assumed" level in the General Plan; <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br /> AS FOLLOWS: <br /> <br /> <br />
