Ci}Y OF PLEASANION COUNTY OF ALAMEDA STATE OF CALIFORNIA A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY OF THE CITY OF PLEASANTON REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A PUBLIC SEWER AND APPURTENANCES THERETO ACROSS PORTIONS OF LANDS BETWEEN VINEYARD AVENUE AND THE ARROYO DEL VALLE, ALL WITHIN THE COUNTY OF ALAMEDA, STATE OF CALIFORNIA; AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF CERTAIN REAL PROPERTY, TOGETHER WITH THE PRIVILEGE AND RIGHT OF TEMPORARY USE OF AN ADJACENT WORKING AREA TO BE USED BY THE CITY FOR THE CONSTRUCTION OF SAID PUBLIC SEWER AND APPURTENANCES THERETO WITHIN THE AREA AFORESAID; AND DECLARING THE INTENTION OF THE CITY OF PLEASANTON TO ACQUIRE SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS, AND DIRECTING THE CITY ATTORNEY OF THE CITY OF PLEASANTON TO COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA, IN AND FOR THE COUNTY OF ALAMEDA~ FOR THE PURPOSE OF ACQUIRING SAID REAL PROPERTY, TOGETHER WITH THE PRIVILEGE AND RIGHT OF TEMPORARY USE OF AN ADJACENT WORKING AREA. The Council of the City of Pleasanton does hereby resolve as follows: 1. The public interest, convenience and necessity of the City of Pleasanton and the inhabitants thereof require the construction, operation and maintenance of a public sewer and appurtenances thereto across portions of the following property: Real property in the City of Pleasanton, County of Alameda, State of California, described as follows: See Exhibit A attached hereto and made a part hereof. 2. The public interest, convenience and necessity of said city and the inhabitants thereof demand the acquisition and taking of the hereinafter described real property for the construction, operation and maintenance of said public sanitary sewer and appurtenances thereto on said property, together with the privilege and right of temporary use of an adjacent working area. 3. The property to be condemned is hereafter described in separate parcels designated as Parcel 504 (Mills), Parcel 508 (Paulo), Parcel 509 (Campagna), Parcel 514 (Riccio), Parcel 515 (Freitas), Parcel 516 (Vargas), Parcel 517 (Frazier and Bowen), Parcel 518 (Kerr), Parcel 520 (Bacigalupi) and Parcel 522 (Allen) Further descriptions of said separate parcels, showing the portion of the entire proposed right of way in Exhibit A are atta hereto, and made a part hereof, and designated "Legal Description 4. The taking and acquiring by said city of the property hereinbefore described is deemed necessary for the construction, operation and maintenance of said public sanitary sewer and appurtenances thereto by the City of Pleasanton and the inhabi- tants thereof for a municipal purpose; such use is a public use, ~.hed
