CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1485 AN ORDINANCE AMENDING CHAPTER 13.0 4 OF THE PI~ASANTON MUNICIPAL CODE CONCERNING SIDEW~I~ DINING AND SIDEWAT~ DECORATIVE DISPLAYS WHEREAS, recently there have been requests by several downtown business people to use the public sidewalks in front of their businesses for outdoor dining or decorative displays; and WHEREAS, it is recognized that properly regulated outdoor dining and decorative displays can enhance the downtown area without causing interference with the public's use of the sidewalks; and WHEREAS, the City of Pleasanton has applied for an amendment to the Pleasanton Municipal Code to permit the use of public sidewalks for non-alcoholic food service and decorative displays by adjoining businesses; and WHEREAS, a duly noticed public hearing was held on September 18, 1990 at which time all public testimony and relevant exhibits were considered. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Section 13.04,010 of the Pleasanton Municipal Code is hereby amended to read as follows: "13.04,010 Definitions For purposes of this Chapter the following words and phrases shall have the meanings as follows: (Subparagraphs A - H, no change). I. 'Sidewalk Decorative Display' means the use of a public sidewalk for a small exhibition of merchandise which is offered for sale within an adjacent indoor retail establishment. J. 'Sidewalk Dining' means the use of a public sidewalk for the consumption of food and/or non-alcoholic beverages in conjunction with and adjacent to an indoor restaurant, delicatessen, or ice cream/yogurt shop."
