CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1485 <br /> <br /> AN ORDINANCE AMENDING CHAPTER 13.0 4 OF THE <br /> PI~ASANTON MUNICIPAL CODE CONCERNING SIDEW~I~ <br /> DINING AND SIDEWAT~ DECORATIVE DISPLAYS <br /> <br />WHEREAS, recently there have been requests by several downtown business <br /> people to use the public sidewalks in front of their <br /> businesses for outdoor dining or decorative displays; and <br /> <br />WHEREAS, it is recognized that properly regulated outdoor dining and <br /> decorative displays can enhance the downtown area without <br /> causing interference with the public's use of the sidewalks; <br /> and <br /> <br />WHEREAS, the City of Pleasanton has applied for an amendment to the <br /> Pleasanton Municipal Code to permit the use of public <br /> sidewalks for non-alcoholic food service and decorative <br /> displays by adjoining businesses; and <br /> <br />WHEREAS, a duly noticed public hearing was held on September 18, 1990 <br /> at which time all public testimony and relevant exhibits were <br /> considered. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Section 13.04,010 of the Pleasanton Municipal Code is hereby amended to read as follows: <br /> <br /> "13.04,010 Definitions <br /> <br /> For purposes of this Chapter the following words and phrases <br /> shall have the meanings as follows: <br /> <br /> (Subparagraphs A - H, no change). <br /> <br /> I. 'Sidewalk Decorative Display' means the use of a public <br /> sidewalk for a small exhibition of merchandise which is <br /> offered for sale within an adjacent indoor retail <br /> establishment. <br /> <br /> J. 'Sidewalk Dining' means the use of a public sidewalk for <br /> the consumption of food and/or non-alcoholic beverages in <br /> conjunction with and adjacent to an indoor restaurant, <br /> delicatessen, or ice cream/yogurt shop." <br /> <br /> Page 1 <br /> <br /> <br />
