O. "Service reduction" means any reduction in housing services which results in a cost <br />savings to the park owner without a corresponding reduction in the monies demanded or paid for <br />space rent. <br /> <br /> P. "Space rent" means the consideration, including any bonus, benefits, or gratuity, <br />demanded or received in connection with the use and occupancy ofa mobilehome park or for the <br />transfer of a lease for park space, services and amenities, subletting and security deposits, but <br />exclusive of any amounts paid for the use of the mobilehome dwelling unit. <br /> <br /> Q. "Transfer of ownership" means any voluntary or involuntary sale, assignment or <br />transfer of ownership of a mobilehome or of any interest in the mobilehome, including, but not <br />limited to, a fee simple interest, a joint tenancy interest, a life estate, or an interest evidenced by a <br />land contract by which possession of the mobilehome is transferred and the Resident retains title, <br />but excluding transfers by a living trust, lease, gift, devise or inheritance to an existing spouse, <br />surviving joint tenant, or a spouse as part of a dissolution proceeding or in connection with a <br />marriage. <br /> <br />6.60.030 Process Concerning Issues Other than Petitions for Fair Return Adjustments, <br />Base Year Rent Adjustments, and Service Reductions. <br /> <br /> A. Initiation of Request. The City Manager may meet on an issue or issues of <br />interest to a Resident or Park Owner, including the calculations used for a rent increase. The <br />request must be in writing but shall not require any particular number of signatures beyond that <br />of the person making the request. The request must identify the problem(s) to be addressed by <br />the City Manager and may recommend a solution. <br /> <br /> B. Prerequisite to Written Request. The City Manager may consider a request that <br />involves a specific Park but the request may be considered by the City Manager only after the <br />following events have occurred: <br /> <br /> 1. The person making the request has submitted the issue in writing to the <br />Park Owner. <br /> <br /> 2. A satisfactory resolution of the issue has not been achieved within 30 days <br />fi'om the written submittal. <br /> <br />The City Manager may select whatever professional persons are deemed necessary to assist in <br />reviewing the request. <br /> <br /> C. Binding Arbitration. If the City Manager is unable to resolve the issue to the <br />satisfaction of all parties, the City Manager shall designate an impartial arbitrator who shall <br />decide the issue through binding arbitration. The costs of arbitration shall be split equally <br />between the affected Park Owner, the affected Resident(s), and the City of Pleasanton. The City <br />Manager may elect for the City to assume the costs of arbitration for an affected Park Owner or <br />the affected Resident(s). <br /> <br />7 <br /> <br /> <br />
