CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 01-115 <br /> <br />RESOLUTION ESTABLISHING A COMPENSATION <br />POLICY FOR MILITARY RESERVISTS EMPLOYED BY <br />THE LIVERMORE-PLEASANTON FIRE DEPARTMENT <br /> <br />WHEREAS, <br /> <br />in accordance with state and federal law, any employee who is a member of the <br />California National Guard or a United States Military Reserve organization shall <br />receive, during the employee's first thirty (30) calendar days on active duty or <br />temporary military leave, full salary as if working his/her regular schedule with the <br />Livermom-Pleasanton Fire Department (LPFD); and <br /> <br />WHEREAS, the law provides the flexibility for employers to determine the level of <br /> compensation, if any, beyond the thirty (30) day mandate. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Section 2: <br /> <br />Should the active duty or temporary military leave continue beyond thirty (30) <br />days, the employee shall receive the difference between the amount of his/her <br />military pay and the amount he/she would have received if working as regularly <br />scheduled with the LPFD, for a period extending up to one year from the start of <br />the military leave. During this time period, benefits shall be paid, paid time-off <br />shall accrue, and PERS retirement credit shall be accrued, as if the employee were <br />working his/her normal schedule. <br /> <br />Any employee receiving compensation pursuant to Section 1 who does not return <br />to LPFD service within thirty (30) days of being released from active duty, and <br />who is physically able to return to work, shall have that compensation treated as a <br />loan payable with interest at a rate to be determined by the JPA Executive <br />Directors. This does not apply to compensation earned during the first thirty (30) <br />calendar days of leave, pursuant to state and federal law. <br /> <br />Section 3: This compensation policy shall not apply to any active duty served voluntarily. <br /> <br /> <br />
