7. A minimum of 102 trees shall be installed on-site. At least 15 percent of the trees <br /> on-site shall be of 24 inch box size or larger. The location and type shall be subject <br /> to review and approval by the Planning Director prior to final map approval. <br /> <br />8. A homeowner's association shall be established for the subject property. The <br /> CC&R's for the association shall incorporate the following conditions: <br /> <br /> a. Long term parking is prohibited in the driveways of the units. Except for <br /> overnight loading and unloading from trips, no overnight parking is allowed. <br /> Boats and recreational vehicles shall not be parked on site. <br /> <br /> b. The 10 parking spaces located throughout the development shah be reserved <br /> for guests. No overnight parking by occupants shall be allowed. <br /> <br /> c. All trees located within the rear yard areas shall be maintained in good health <br /> and vigor at all times. <br /> <br /> d. The garage parking spaces shall not be used for long term storage, in excess of <br /> 72 hours, and shall be maintained unobstructed and available for parking of <br /> vehicles. <br /> <br />9. That the developer shall establish a homeowners association through the CC&R's for <br /> the project. The association shall be responsible for maintaining all common open <br /> space, private utilities, private streets, project walls, and other common areas and <br /> improvements within the development. The City shall be granted the rights and <br /> remedies of the association, but not the obligation, to enforce the maintenance <br /> obligations. The City Attorney shall review and approve the proposed CC&R's prior <br /> to the recordation of a final subdivision map for the project. <br /> <br /> 10. The homeowner' s association for the project shall be responsible for the maintenance <br /> of the landscape area along the property's frontage, up to the back of sidewalk along <br /> Santa Rita Road including that area behind the sidewalk. <br /> <br /> 11. The proposed soundwall in terms of design, color and material shall be as shown on <br /> sheet 5 and 8 feet in overall height. Specific details including final location, design, <br /> landscape berming, and materials shall be submitted for review and approval by the <br /> Planning Director prior to issuance of building permits. In general, the location shall <br /> follow the recommendation of the acoustical report prepared by Charles M. Salter & <br /> Associates dated January 25, 1991. <br /> <br /> 12. If archaeologic materials are uncovered during grading, trenching or other on-site <br /> excavation, earthwork within 30 meters of these materials shall be stopped until a <br /> professional archaeologist who is certified by the Society of California Archaeology <br /> <br /> <br />
