loss of privacy (Final EIR, page 5-12). <br /> <br />Facts: <br /> <br />(Regarding the 107 unit development plan now proposed by <br />the project developer.) <br /> <br /> 1. Bonde Ridge ("E" Court) <br /> <br /> The project developer uses two custom lots and one <br /> split pad lot to reduce cut slopes. Lots 67 and 79 <br /> were "pulled" away from Bernal Avenue saving an <br /> existing oak tree that would have been removed with <br /> the original plan. The project developer will <br /> shorten "E" Court so that the existing ridgeline is <br /> not graded for either the street or lots. The <br /> final site plan and grading plan will be reviewed <br /> with the tentative map. These changes implement <br /> Mitigation 5.1.a (Final EIR, page 5-14) reducing <br /> the visual impacts to a less than significant <br /> level. <br /> <br /> 2. Old Towne (Windmill Way) Area <br /> <br /> The developer would develop Lots 46 through 48 and <br /> Lot 50 with single-story buildings set well forward <br /> on these lots. Lot 49C would likely be a split <br /> level one story house in order to conform to <br /> natural terrain. Building pads for Lots 46-50 <br /> would be set lower than "B" Street, and would be <br /> from 12-19' higher than the downslope Old Towne <br /> properties' pads. The average depth of Lots 46-50 <br /> is 190', enabling very deep rear yards between the <br /> houses on these lots and the rear property lines. <br /> Lot 49C would keep its natural creek channel. <br /> <br /> A 10' area of unclear title would be quitclaimed to <br /> the downslope property owners and an additional 10' <br /> area, with landscaping, from Lots 46-50 would be <br /> deeded to them. On this 10' area, the developer <br /> would build a maximum 2:1 grade slope up to the new <br /> rear property line for Lots 46-50. (The Old Towne <br /> lots already have slope banks ranging from 4-8' in <br /> height.) <br /> <br /> The intent of the grading plan is to have an <br /> essentially flat, usable rear yard for Lots 46-48 <br /> and 50 so that regrading, decks, etc., should not <br /> become the issue it has in other subdivisions. <br /> With the final map, the developer shall record over <br /> lots 46 through 50 a scenic easement or other <br /> mechanism to control buildings and landscaping from <br /> <br /> - 8 - <br /> <br /> <br />
