CITY COUNCIL OF THE CITY OF PT~ASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1529 AN ORDINANCE OF THE CITY OF PT~ASANTON AMENDING THE PT~ASANTON MUNICIPAL CODE BY ENACTING, ADOPTING, AND ADDING THERETO A NEW CHAPTER 9.32 TO TITT~ 9, REGULATING ACCESSIBILITY TO CIGARETTES AND OTwRR TOBACCO PRODUCTS BY PROHIBITING CIGARETTE VENDING MACHINES. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The Pleasanton Municipal Code is hereby amended by enacting, adopting, and adding thereto a new chapter to Title 9, concerning public health, safety and welfare, said new chapter to be numbered and to read as follows: "Chapter 9.32 RESTRICTIONS ON ACCESSIBILITY TO CIGARETTES AND OTFn~.RTOBACCO PRODUCTS Section 9.32.010. Legislative Findings and Declarations. The City Council hereby finds and determines that the adoption of this ordinance is necessary to the promotion of the public health, safety and welfare. Each of the reasons set forth below provides a separate and independent basis for the Council's adoption of this ordinance. A. Substantial scientific evidence supports the causal relationship between using tobacco products and the deadly diseases such as lung cancer, chronic bronchitis, heart disease, emphysema and other types of cancer. The Surgeon General of the United States has determined that smoking is the leading cause of preventable death in this country. B. An estimated annual 31,000 deaths in the State of California and 434,175 deaths nationwide are caused by cigarette smoking. The estimated annual economic burden to the State of California resulting from smoke-related health care costs and lost productivity is over $7.1 billion. C. Ninety percent (90%) of cigarette smoking initiation occurs between the ages of 9 through 18 years. -1-
