CITY COUNCIL OF THE CITY OF PT~ASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1529 <br /> <br /> AN ORDINANCE OF THE CITY OF PT~ASANTON <br /> AMENDING THE PT~ASANTON MUNICIPAL CODE BY <br /> ENACTING, ADOPTING, AND ADDING THERETO A NEW <br /> CHAPTER 9.32 TO TITT~ 9, REGULATING <br /> ACCESSIBILITY TO CIGARETTES AND OTwRR TOBACCO <br /> PRODUCTS BY PROHIBITING CIGARETTE VENDING <br /> MACHINES. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: The Pleasanton Municipal Code is hereby amended by <br /> enacting, adopting, and adding thereto a new chapter to <br /> Title 9, concerning public health, safety and welfare, <br /> said new chapter to be numbered and to read as follows: <br /> <br /> "Chapter 9.32 <br /> <br /> RESTRICTIONS ON ACCESSIBILITY TO <br /> CIGARETTES AND OTFn~.RTOBACCO PRODUCTS <br /> <br /> Section 9.32.010. Legislative Findings and Declarations. <br /> <br /> The City Council hereby finds and determines that the adoption <br />of this ordinance is necessary to the promotion of the public <br />health, safety and welfare. Each of the reasons set forth below <br />provides a separate and independent basis for the Council's <br />adoption of this ordinance. <br /> <br /> A. Substantial scientific evidence supports the causal <br /> relationship between using tobacco products and the deadly <br /> diseases such as lung cancer, chronic bronchitis, heart <br /> disease, emphysema and other types of cancer. The Surgeon <br /> General of the United States has determined that smoking is <br /> the leading cause of preventable death in this country. <br /> <br /> B. An estimated annual 31,000 deaths in the State of <br /> California and 434,175 deaths nationwide are caused by <br /> cigarette smoking. The estimated annual economic burden to <br /> the State of California resulting from smoke-related health <br /> care costs and lost productivity is over $7.1 billion. <br /> <br /> C. Ninety percent (90%) of cigarette smoking initiation <br /> occurs between the ages of 9 through 18 years. <br /> <br /> -1- <br /> <br /> <br />
