CITY COUNCIL CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1528 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF GOLDEN EAGLE <br /> FARM JOINT VENTURE FOR A MAJOR MODIFICATION TO AN <br /> APPROVED PUD DEVELOPMENT PLAN TO MODIFY CONDITION <br /> NUMBER 1B OF PUD-85-15, AS FILED UNDER CASE <br /> PUD-85-15-2M <br /> <br />WHEREAS, Golden Eagle Farm Joint Venture has applied for a major <br /> modification to an approved Planned Unit Development to <br /> modify Condition Number lb of PUD-85-15, deleting the <br /> requirement that twenty of the upper lots be the last <br /> lots in the project subdivided and offered for sale; <br /> and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit <br /> Development) - Low Density Residential District; and <br /> <br />WHEREAS, this application is categorically exempt from the <br /> requirements of the California Environmental Quality <br /> Act; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed major <br /> modification to the approved planned unit development; <br /> and <br /> <br />WHEREAS, a duly noticed public hearing was held on October 15, <br /> 1991; and <br /> <br />WHEREAS, the City Council finds that this major modification is <br /> consistent with the General Plan policies of the City <br /> of Pleasanton. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. Approves the application of Golden Eagle Farm Joint <br /> Venture for a major modification to an approved Planned <br /> Unit Development to modify Condition Number lb of PUD- <br /> 85-15, deleting the requirement that twenty of the <br /> upper lots be the last lots in the project subdivided <br /> and offered for sale, subject to the conditions on <br /> "Exhibit A" attached hereto and by this reference <br /> incorporated herein. <br /> <br /> <br />
