CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1531 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF KAY <br /> KU FOR REZONING AND DEVELOPMENT PLAN APPROVAL <br /> AS FILED UNDER CASE PUD-91-02 <br /> <br />WHEREAS, Kay Ku has applied to rezone a 2.82 acre site from the <br /> "A" (Agricultural) zoning district to the PUD (Planned <br /> Unit Development) - Low Density Residential zoning <br /> district and development plan approval for a three-lot <br /> single-family custom home development located at 5130 <br /> Foothill Road; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on November 19, 1991; <br /> and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the rezoning and <br /> development plan approval; and <br /> <br />WHEREAS, a duly noticed public hearing was held on November 19, <br /> 1991; and <br /> <br />WHEREAS, the City Council finds that this development plan and <br /> rezoning is consistent with the General Plan policies of <br /> the City of Pleasanton. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the rezoning of an approximately 2.82 acre <br /> parcel located at 5130 Foothill Road to the PUD (Planned <br /> Unit Development) - Low Density Residential District. <br /> <br />Section 2: The Zoning Map of the City of Pleasanton dated <br /> April 18, 1960, on file with the City Clerk, designating <br /> and dividing the City into zoning districts is hereby <br /> amended by Zoning Unit Map No. 405, attached hereto as <br /> Exhibit "A", dated November 19, 1991, and incorporated <br /> herein by this reference. <br /> <br />Section 3: Approves the development plan to allow a three-lot <br /> single-family custom home development on a 2.82 acre <br /> parcel located at 5130 Foothill Road, subject to the <br /> conditions on Exhibit "B", attached hereto and <br /> incorporated herein by this reference. <br /> <br /> <br />
