CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1545 <br /> <br /> AN ORDINANCE OF THE CITY OF pLEASANTON <br /> AMENDING ORDINANCE NO. 1336, AS AMENDED, AND <br /> SECTION 17.36.230 OF THE pT.RASANTON MUNICIPAL <br /> CODE, AS AMENDED, CONCERNING LAPSING OF GROWTH <br /> MANAGEMENT APPROVAL <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br />Section_____!l: Section 1 (part) of Ordinance No. 1336, as amended, and <br /> Section 17.36.230 of the Pleasanton Municipal Code, as <br /> amended, are hereby further amended to read as follows: <br /> <br /> ,,Section 17.36.230 Lapse of approval. <br /> <br /> (existing) A. Growth management approval shall lapse and <br /> become null and void as to any approved unit <br /> for which no building permit has been obtained <br /> prior to December 31st of the calendar year <br /> following the calendar year for which the <br /> growth management approval was granted. <br /> <br /> (new) B. Notwithstanding subsection A above, the City <br /> Council in its sole discretion may extend <br /> growth management approval for up to an <br /> additional twelve months: <br /> <br /> 1. Upon a showing that an applicant for a <br /> multi-year project has obtained a <br /> significant number of building permits <br /> within the project; or <br /> <br /> 2. An applicant pays, by a date specified by <br /> City Council, all fees which are payable <br /> upon the issuance of building permits for <br /> the project. <br /> <br /> (existing) C. If a building permit expires after its growth <br /> management approval has expired, then the <br /> building permit cannot be renewed without a <br /> new growth management approval. Once a <br /> building permit is issued its time of <br /> expiration shall be controlled by Uniform <br /> Building Code Standards. <br /> <br /> (ex~st~n~) D. The owner of a lot created by a final map <br /> recorded prior to the expiration of growth <br /> <br /> <br />
