CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1557 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF FRED <br /> HEMPY FOR DEVELOPMENT PLAN APPROVAL AS FILED <br /> UNDER CASE PUD-91'19 (AP-92-6) <br /> <br />WHEREAS, Fred Hempy applied for development plan approval to <br /> construct one single-family home on an approximately 1.25 <br /> acre portion of an approximately 2.40 acre site located <br /> at 5226 Foothill Road; and <br /> <br />WHEREAS, at its meeting of March 25, 1992, the Planning Commission <br /> denied the application for development plan approval as <br /> submitted; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, the applicant submitted an appeal to the City <br /> Council; and <br /> <br />WHEREAS, based on the Initial Environmental Study indicating no <br /> significant adverse effects on the environment, a <br /> negative declaration was adopted by Council on April 21, <br /> 1992; and <br /> <br />WHEREAS, a duly noticed public hearing was held on April 21, 1992; <br /> and <br /> <br />WHEREAS, the City Council finds that this development plan is <br /> consistent with the City of Pleasanton General Plan <br /> policies. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the development plan for construction of one <br /> single-family home on an approximately 1.25 acre portion <br /> Of an approximately 2.40 acre site located at 5226 <br /> Foothill Road, subject to the conditions in Exhibit "B", <br /> attached hereto and incorporated herein by this <br /> reference. <br /> <br />Section 2: The City staff is directed to cause a Notice of <br /> Determination to be filed pursuant to Section 5.4(g) of <br /> Resolution No. 77-66. <br /> <br /> <br />
