CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1556 AN ORDINANCE APPROVING THE APPLICATION OF KAUFMANAND BROAD FORREZONINGAND DEVELOPMENT PLAN APPROVALAS FILED UNDER CASE PUD-91-17 WHEREAS, Kaufman and Broad applied to have an approximately 17-acre parcel rezoned to the PUD-MDR (Planned Unit Development - Medium Density Residential) District and for development plan approval to construct 108 single- family homes on such parcel, located generally on the north side of Stanley Boulevard between First Street and California Avenue (3801 Stanley Boulevard); and WHEREAS, at its meeting of March 11, 1992, the Planning Commission denied the application for a General Plan Amendment from High Density Residential to Medium Density Residential and took no action on the rezoning and on the development plan as submitted; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant submitted an appeal to the City Council; and WHEREAS, based on the Initial Environmental Study indicating no significant adverse effects on the environment, a negative declaration was adopted by Council on April 7, 1992; and WHEREAS, a duly noticed public hearing was-held on April 7, 1992; and WHEREAS, the City Council granted the application for a General Plan amendment to Medium Density Residential for this property; and WHEREAS, 'the City Council finds that the rezoning and the development plan are consistent with the City of Pleasanton General Plan policies. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Grants the appeal and approves the rezoning of an approximately 17 acre site located generally on the north side of Stanley Boulevard between First Street and California Avenue (3801 Stanley Boulevard) to the PUD (Planned Unit Development) - MDR (Medium Density Residential) District.
