CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1556 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> KAUFMANAND BROAD FORREZONINGAND DEVELOPMENT <br /> PLAN APPROVALAS FILED UNDER CASE PUD-91-17 <br /> <br />WHEREAS, Kaufman and Broad applied to have an approximately <br /> 17-acre parcel rezoned to the PUD-MDR (Planned Unit <br /> Development - Medium Density Residential) District and <br /> for development plan approval to construct 108 single- <br /> family homes on such parcel, located generally on the <br /> north side of Stanley Boulevard between First Street and <br /> California Avenue (3801 Stanley Boulevard); and <br /> <br />WHEREAS, at its meeting of March 11, 1992, the Planning Commission <br /> denied the application for a General Plan Amendment from <br /> High Density Residential to Medium Density Residential <br /> and took no action on the rezoning and on the development <br /> plan as submitted; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, the applicant submitted an appeal to the City <br /> Council; and <br /> <br />WHEREAS, based on the Initial Environmental Study indicating no <br /> significant adverse effects on the environment, a <br /> negative declaration was adopted by Council on April 7, <br /> 1992; and <br /> <br />WHEREAS, a duly noticed public hearing was-held on April 7, 1992; <br /> and <br /> <br />WHEREAS, the City Council granted the application for a General <br /> Plan amendment to Medium Density Residential for this <br /> property; and <br /> <br />WHEREAS, 'the City Council finds that the rezoning and the <br /> development plan are consistent with the City of <br /> Pleasanton General Plan policies. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: Grants the appeal and approves the rezoning of an <br /> approximately 17 acre site located generally on the north <br /> side of Stanley Boulevard between First Street and <br /> California Avenue (3801 Stanley Boulevard) to the PUD <br /> (Planned Unit Development) - MDR (Medium Density <br /> Residential) District. <br /> <br /> <br />
